Terms of Use

These Terms of Use (or "Terms") govern your use ofYareta(𾱲Բڳٱthe "Portal" or “Yareta”), exceptin the case we wouldexpressly state that separate terms (and not these) apply, and provide information aboutYareta, outlined below. When you create aYaretaaccount or useYareta, you agree to these Terms.

  1. Data Protection Policy

AsYaretais a product of the AVƵ (hereafter UNIGE), theis applicable totheYaretaPortal.

In order to use theYaretaPortal, we require you to consent to the collection and processing of your personal data before you start using the services. If you do not agree with the terms of the Data Protection Policy, you may not create an account on theYaretaPortal.

Access to content on theYaretaPortal is open to all.

2.1 Scope of application

Yaretaisaservice,composedof a modular infrastructure and thenecessaryprocedures for the operationalization of a solution for themanagement, preservation and publication of research data, adapted to both researchers and institutions, supporting most of the tools and formats used in all scientific disciplines and in complete security.

2.2 Applicable Law

The services provided byYaretacomply with theLaw on Public Information, Access toDocuments, and Protection of Personal Data(LIPAD)and theCode of Obligations(CO).Only Swiss law is applicable.

2.3 Acceptance of Conditions

UNIGEprovides theYaretaPortalon the basis ofthese Terms.

UNIGEreserves the right to change theseTermsany time by publishing the updated version without prior notice.In this event,partner institutions and users(hereinafter “depositors”)will be asked to accept the new Terms. Any substantial changes will be clearly indicated.

The use ofYaretais subject totheacceptance of these Terms.

Without express acceptance of the Terms, you will not be able to useYareta.

2.4 Definitions

Content

  • Scope: All fields of research. All types of research artifacts.Content must not violate privacy or copyright, or breach confidentiality or non-disclosure agreements for data collected from human subjects.

  • Eligibility ofresearch data:Research datafrom any stage of the researchdatalifecycleis accepted.

  • Eligible depositors: Anyone registered withSWITCHaaior SWITCHedu-IDaccount linked to Geneva higher education institution (including theGeneva AVƵ Hospitals,HUG)may create an organizational unit to deposit data. Registered users are allowed to depositcontent for which they possess the appropriate rights.

  • Ownership: By uploading content,no change of ownership isimplied,and no property rights are transferred to Yareta. All uploaded content remains the property of the users prior to submission.

  • Data file formats: Allfileformats are allowedeventhose that are not suitable forpreservation. Acompliancesystem (inthe form of stars)allows“unfriendly formats” to be distinguished from “golden formats”.

  • Volume and size limitations:There is no technical limit to the amount of data you may deposit.Any limitdepends solely on thepricing.

  • Metadata types and sources: All metadata are stored internally in XML-format. Metadata are exported according to the.

  • Language: For textual items, all languages areaccepted.

  • Licenses: Users must specify a license for all publicly available files.Licenses for closed access files may be specified in theMetadata form.

Access and Reuse

  • Access to data objects: Files may be depositedinclosed, restricted,oropenaccess(withthepossibility ofembargoesas explainedfurther down). Files deposited under closed access are protected against unauthorized access at all levels. Access to metadata and data files is provided over standard protocols such as HTTPSand.

  • Use and re-use of data objects: Use and re-use are subject to the licensechosen by the userunder which the data objects were deposited.

  • Embargo status: Users may deposit content under an embargo status and provide an end date for the embargo. The repository will restrict access to the data until the end of the embargo period; at which time, the content willautomaticallybecome publiclyavailable.

  • Restricted Access: Users may deposit restricted files with the ability to share access with others if certain requirements– chosen by user –are met. These files will not be made publicly available,and sharing will only be made possible bytheoriginal file approvaldepositor.

  • Metadata access and reuse: Metadata are licensed under. All metadata are exported viaand can be harvested.

Removal

  • Withdrawal: If the uploaded research object must later be withdrawn,Yaretawill indicatethe reason for thiswithdrawal on a tombstone page, which will henceforth be served in its place. Withdrawal is considered an exceptional action, which normally should be requested and fully justified by the originaldepositor. In any other circumstance reasonable attempts will be made to contact the originaldepositorto obtain consent. Theand the URL of the original object are retained.

Longevity

  • Versions:Metadataare versionedbut notData files.The uploadedData filesarearchived as a Submission Information Package. Derivatives ofData files are generated, but originalData files arenever modified.Archivescan be retracted from public view; however, the data files andMetadataare preserved.

  • Replicas: All data files are storedintheUNIGE data centers in Geneva, Switzerland. Datasets are kept in two replicas on redundant architectures.

  • Retention period: Items will be retained for the lifetime indicated upon deposit.

  • Functional preservation: UNIGEmakes no promises of usability and understandability of deposited objects overtime butrecommends“golden formats” to increase functional preservation on the very long term.

  • Fixity and authenticity: AllData files are stored along with a checksum (small-sized block of dataderived fromthedatasetsfor the purpose of detecting errors that may have been introduced duringtheirtransmission or storage);different checksum formats are used. Filechecksumsare regularly checked toensurethatthe corresponding datasetsremainintact.

  1. Obligations,Responsibility andJurisdiction

3.1Depositor obligations

Depositorsare to ensure that research data management requirements from ethical, statutory, academic, funding and publishing bodies are observed, including appropriate handling of personal and confidential data, as stipulated by theLIPAD,the Federal Act on Research involving Human Beings (HRA)or any of the laws applicable to their deposited Data files.

3.2 Responsibility for the content deposited onYareta

UNIGEdeclines all responsibility for the content posted on theYaretaplatform by itsdepositors.It is emphasized that depositors remain responsible for the content of the archives and collections they create onYareta.Depositors may be asked to make necessary changes and/or additions to their Data files and Metadata in order to comply with these Terms. In case of non-compliance, UNIGE may take certain measures and draw consequences at the discretion of the UNIGEYaretateam.

UNIGEreserves the right to migrate, curate, move, etc.,thedeposited datain ordertoguaranteecontinued access to its archives in the event of cessation of operations.

UNIGEis solely responsible for the services and obligations arising from the contractual relationship betweenUNIGEanddepositors.

3.3 Place of jurisdiction

By accepting the Terms, you expressly agree tothe jurisdiction of the Geneva CourtsandSwiss Federal SupremeCourt.
